Terms of Use

These Terms of Use ("Terms") govern your access to and use of this website, its content, and any products or services offered by BGR Technical Publications^TM (owned by Burger, Inc., a Nevada corporation). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

We may update these Terms at any time. Changes are effective upon posting. Please check this page whenever you visit.

1) Definitions

• "Site" means this website and its pages, content, and services.
• "Content" means all text, images, graphics, exams, questions, explanations, PDFs, downloads, and other materials we make available.
• "Products" means both printed workbooks and digital items (for example, Instant Download PDFs and online tools).
• "Digital Products" means Content delivered electronically, including downloads and access-controlled services.
• "CBT Exam System" means our computer-based testing practice system and related files or media that simulate taking practice exams using the same practice questions contained in our corresponding PDF workbook for the named ICC exam. The CBT Exam System may be delivered online or via removable media (for example, CD, thumb drive, or other electronic memory device).
• "We," "us," "our" means Burger, Inc., dba BGR Technical Publications^TM.
• "You" means the individual purchaser or authorized user.
• "ICC" stands for The International Code Council, a U.S. nonprofit that develops model building codes and standards. "ICC" is a registered trademark of the International Code Council. Our use of the term "ICC" is nominative and only to identify the public exam titles for which our practice materials are designed. Burger, Inc. and BGR Technical Publications^TM are not affiliated with, endorsed by, or sponsored by the ICC.

2) Acceptable Use of the Site

You may use the Site and its Content for lawful purposes only. You may not: (a) interfere with the Site's operation; (b) attempt to access accounts or data not intended for you; (c) use automated means to scrape or copy Content; or (d) use the Site in a way that violates applicable laws or infringes the rights of BGR Technical Publications^TM or others.

3) Intellectual Property

The Site and its Content are the copyrighted property of Burger, Inc. (and/or its licensors). All rights are reserved worldwide. No rights are granted except as expressly stated in these Terms or a separate written agreement. You may not copy, modify, distribute, publicly display, or create derivative works from the Content unless expressly permitted.

4) Orders, Shipping & Transfer of Title (FOB)

Printed Products ship FOB shipping point. Title and risk of loss transfer to you upon our delivery of your order to the carrier. Delivery times shown are estimates. We are not responsible for delays after transfer to the carrier.

5) Digital Products & License

Digital Products (including PDFs and any access-controlled tools) are licensed, not sold, to the purchasing individual. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license for personal study by the single purchaser only. Classroom, corporate, multi-user, or public use requires our prior written consent.

6) Access Window & Download Limits

Access to Digital Products (downloads and links) is provided through your account. We may set reasonable limits on download counts, link expirations, device activations, or attempts to protect against abuse. If you need extended access for legitimate reasons, contact us and we will make a good-faith effort to assist.

7) CBT Exam System (Applies to Online and Removable Media)

• Coverage. For a given exam, the CBT Exam System uses the same practice questions contained in our corresponding PDF workbook for the named ICC exam. It does not provide official ICC exam content.
• Eligibility and Price. The CBT Exam System is provided at no additional charge to purchasers of the corresponding PDF workbook, in our discretion.
• License and Scope. Use is licensed to the single purchasing individual for personal study only and is non-transferable. Sharing, resale, public posting, or multi-user access is prohibited unless we approve in writing.
• Access Period. Unless otherwise stated, access to each CBT Exam System exam is provided for 1 year from activation and may be renewed or extended at Burger, Inc.'s option.
• Medium. These terms apply regardless of delivery method, including online, CD (compact disc), thumb drive (memory stick), or any other electronic memory device.
• Agreement. By using the CBT Exam System, you accept these Terms (including this Section 7) in full.
• Service Changes. We may modify, suspend, or terminate the CBT Exam System at any time without further notice. If reasonable under the circumstances, we may offer alternative access or replacement materials, but are not obligated to do so.
• No ICC Affiliation. "ICC" is a registered trademark of the International Code Council. We are not affiliated with, endorsed by, or sponsored by the ICC; our references are nominative only.

8) No Sharing, Resale, or Public Posting

• No sharing or posting any portion of the Content on public forums, social media, or file-sharing services.
• No resale, rental, lending, or distribution of the Content (digital or printed) without written permission.
• No removing copyright notices, watermarks, or other ownership markings.

9) Refunds & Returns

• Digital Products: Non-returnable and non-refundable once delivered or accessed, except where required by law or if we cannot remedy a verified technical issue we control.
• Printed Products: Unused/undamaged items may be returnable within 14 days of delivery with prior authorization; shipping is non-refundable; return shipping is your responsibility; a restocking fee may apply.

10) Replacement & Support Policy

If you experience a delivery or access issue, contact us promptly. We may provide replacement links, updated files, or reasonable technical assistance for supported formats and current browsers. We are not responsible for issues caused by third-party blockers, outdated software, or unsupported environments, but we will try to help where we can.

11) Pricing, Taxes & Payment

Prices are subject to change without notice. You agree to pay all applicable taxes, duties, and fees. We may use third-party payment processors; their terms may apply. Orders may be canceled or limited at our discretion, including for suspected fraud or misuse.

12) Feedback & Submissions

Any comments, suggestions, proposals, or other feedback you provide about the Site or Products are non-confidential and become our exclusive property. We may use them without restriction or compensation.

13) Indemnification

You agree to indemnify, defend, and hold harmless BGR Technical Publications^TM, its licensors, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your misuse of the Site, Content, or CBT Exam System; or (c) any material you provide or incorporate that is not part of our standard Content.

14) Disclaimers & Limitation of Liability

Educational Content Only; No Warranty. The Site and Content are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee exam outcomes or regulatory acceptance.

Limitation. To the maximum extent permitted by law, BGR Technical Publications^TM and its licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or use, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

Risk of Internet Use. We are not responsible for delays, failures, or damages caused by network issues, malware, outages, or events beyond our reasonable control.

15) Privacy & Data

We collect and process personal information as described in our Privacy practices (for example, to fulfill orders, provide access links, and support your account). We do not sell exam content tied to your identity. Do not share your login credentials. You are responsible for all activity under your account.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflict-of-law rules. Exclusive venue for any permitted court action is in state or federal courts located in Las Vegas, Nevada, USA.

17) Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Site will be resolved by binding, individual arbitration administered in Las Vegas, Nevada. You and BGR Technical Publications^TM waive the right to a jury trial and to participate in a class action or class-wide arbitration. You may seek relief in small-claims court if your claim qualifies.
